Supplemental employment benefits plan (SEB) directive

Overview

This directive describes the Supplemental Employment Benefits (SEB) Plan for bargaining unit employees. It covers the SEB plan's purpose, eligibility for the plan, and payment dates and amounts under the plan.

Definition of terms

If there are any discrepancies in how the terms are defined below and the Public Service Act and Public Service Employment Regulation, the Act and Regulation supersede.

Bargaining unit: employees under the Public Service Act designated to be represented by a trade union as the certified bargaining agent, as defined by the Public Service Employee Relations Act.

Leave of Absence With Pay: any period of time for which an employee is authorized to be paid while the employee is away from work and not covered by a specific benefit or entitlement.

Leave of Absence Without Pay: a period of time away from work for which employees are not paid.

Supplemental employment benefits plan

Purpose and eligibility

If a bargaining unit employee is absent from work due to pregnancy, the SEB plan will supplement the Employment Insurance benefits received during the period in which the bargaining unit employee is medically unable to perform their job duties. The employee must provide satisfactory proof of illness for pregnancy-related health reasons and receipt of Employment Insurance benefits.

Payment dates and amounts

The SEB plan will be paid for a maximum of seventeen (17) weeks, including the 1-week Employment Insurance waiting period. It will start no earlier than twelve (12) weeks before the estimated date of delivery and no later than the date of delivery.

The combined SEB plan payment and Employment Insurance benefits will not exceed:

  • 95% of an employee's bi-weekly salary during the period in which sick leave would have been payable at 100%
  • 70% of an employee's bi-weekly salary during the period in which sick leave would have been payable at 70%
